Dependent expemption and tax rebate...who gets the credit?

If you file form 8832 (release of dependent exemption) due to a court order, who would get the $300 per child credit? I%26#039;m the custodial parent, but the non custodial parent gets to claim our child every other year (this tax year)--provided he is caught up in child support-he is) When the rebate is issued, who will it go to?

The dependent rebate will go to the parent who claims the child for 2007.

Seems likely it will go to him - ask him if would split it with you 1/3 to him, 1/3 to you and 1/3 to the kid!
