hello, i am going to file 2006 and 07 taxes and expecting refunds (EIC and Child Tax Credit). I did not file years 2004 and 2005 because i owed about $150 per year and i did not have the money to send so i didn%26#039;t bother file. I now realize that was a big mistake. I am hoping to recieve the refunds and pay what i owe for those other years plus all the unfair fees and penalties. Does anyone know if i can do this or will they stop me from getting the refund years until i pay those other taxes? Do i have to file those years first? Any help would be appreciated. : )

to file when they owe you. By the time you pay the penilty and

I was having that same discussion with a tax preparer from H %26amp; R block. I owe on 2005 taxes, did not owe on 2006 or 2007 taxes. I did not file any of these taxes yet. When I would file the 2006 %26amp; 2007 taxes it may or may not show that I did not file for 2005. The IRS are a few years behind on auditing. That was a chance I would have to take, if my name came up not filing that year, they would probably hold the return owed to me until the year not filed is settled. I waited to file because I did not have the money to pay them, so I figured I would wait and file 06 %26amp; 07 with 05, they would keep the money I owe and not have to pay in installments.

I%26#039;m an inactive enrolled agent now. Recent experience with taxpayers who came to me have shown that the IRS now is assessing {and most of the 41 States that have income tax} what you OWE based upon what income was reported to them by the people you worked for, contracted with, proprietorships, associations, churches, partnerships you may have rented real estate out to; stock transactions reported by your brokerage, inheritances, rents, gain on sales or exchange, etc. So it is serious when you do not file, even for very good reasons [ one lady%26#039;s mother died and she was so stressed she forgot all about taxes. The IRS regards that as no excuse}. In other words, the IRS and the States do not even bother to check their computers to see what tax was taken out of you. If you sent in estimated tax, they count that.
The IRS forces you to give your social security number. Hence, the non-filing will show. They are approximately 19 months behind. That means your non-filing for 2004 and 2005 has likely been discovered by now.
Another reason they are not liable to send your refund first is they check with other government agencies to see if there is a debt claim against you.
You should go through your check-books, receipts, ledgers, diaries and other recordkeeping you used. Hopefully you can find enough expenses to itemize your deductions. Then file a 1040X for tax years 2006 and 2007. That%26#039;s the Amended return form. The three year limitation hasn%26#039;t expired yet. In other words, you may receive your refunds, but be prepared for a large tax bill, penalty and interest later.
Your number one priority is to have documentation. If you get harassed by the IRS, you should contact the taxpayer advocate first. That number is:
1-877-777-4778 or TTY/TTD 1-800-829-4059. There%26#039;s another number, but I%26#039;ve forgotten. I think I forgot to put it up on a website I used to have.
If you get no satisfaction from the taxpayer advocate, you should contact an Enrolled Agent. One that specializes in dealing with the IRS is the president of the Virginia Society of Enrolled Agents, Mr. Winston Macon. I%26#039;ve met the man and heard him speak. He knows what he%26#039;s doing.

It%26#039;s expensive, but if you feel you are in the right, you should stand up to the IRS. In 13 years of practice, I had two clients audited. Won both times, but I do not take credit. You pray a lot. Best to you.

The IRS has a %26quot;refund hold%26quot; program. If you appear to owe on a missing return, your account will be flagged. You won%26#039;t get the refund for the current year until the missing returns are filed. This can be true even if you got a refund last year and the missing return is from 2003.
By not filing, your $150 owed is probably $300. There is a minimum penalty at 60 days of $100 or the amount of tax you owe, whichever is smaller. Interest and penalties have continued since then.
