Each year I have to file a different amount of dependents. My ex and I switch off. We have 3 kids together. One year he claims one and I claim 2, and then the next year we switch. But I always list all 3 kids for the additional child tax credit, which I know is okay to do since they all live with me. So with this additonal refund coming this summer how is the government going to determine what to give me? Will I get the amount for all 3 since they actually live with me?

When you %26quot;switch off%26quot; you are signing a form 8332 to the non-custodial parent. This includes both the $3400 exemption AND the child tax credit. The additional child tax credit is part of the child tax credit, so you can%26#039;t claim all the kids on that form if you didn%26#039;t claim all of the kids as dependents in the first place.



As for the rebate, the IRS will guestimate based on what is shown on your 2007 taxes. If there are 2 kids on the form, they will think you are filing 2 in 2008.
