Can my mother claim EIC for my child?

My household consists of myself, my wife, my mother, and my son who was born last year. My mother qualifies for EIC, but i do not. If i claim the dependency exemption and child tax credit for my son, can my mom use my son for EIC purposes?

Can my mother claim EIC for my child?

No. For your mother to claim the EIC she must also claim the child as her dependent. If you all lived in the same household for over 6 months in 2007, this IS possible so you%26#039;ll have to figure out what%26#039;s the best for the family unit as a whole.
