Nope and you could file seperated head of household I think and get more money for you and your kids. You have to think what is best for your kids. Does he provide enough support? Will he give the extra money to you? what can he give you in return for letting him claim a kid?

This would mean you lived in the same house with him for 10 months of last yr. When you file married filing separate you will see a big difference in tax returns. I would suggest for last yrs taxes, filing them together and splitting the money. That is of course if he can be trusted. If the children are with you don%26#039;t let him claim them on this taxes because he%26#039;s going to be able to keep that money when you%26#039;re going to need it for the kids. It%26#039;s probably best to file separately so you don%26#039;t have to deal with splitting anything up if you file together. Yes you both have to provide the last 3 years (Notice of Assessment) if you are going to court to address access, custody and support. Be sure to get a motion before the court if he has not already and set out your reasons as to why you should get support and detail what you want for access. If he has the child/children in his care or wants shared custody that may be why he wants to claim the UCTC.
