Does a non-custodial parent get the child rebate?

As most of you know, there are rebates going out in a few months.



$600 for a single person



$1200 per married couple



$300 per child (up to 4)



Well, my ex has pysical custody over our daughter, but we share joint legal custody. But she refuses to let me claim her on our taxes and insists on taking all the child tax credits every year even though I pay child support and I%26#039;m part of her life.



So when the checks go out, does she just get the $300?



Do we both get $300? Is it split $150/$150?

unfortuanlty it would be her since she claimed your daughter on her 2007 tax return.



me and my ex are fighting about this except he doesnt want to pay and doesnt see our son but wants full custody of him...but that a different story

should have done this in your divorce hearing to determine who gets to claim the dependent child for which tax year until they are 18,when i got divorced we decided that she gets every even year and i can take every odd year till she turns 18 or graduates high school.and if you over looked this you might want to take her back to court and see if you can have your papers changed,will have to get a lawyer to see just what you can do ..
